FDA NEW RULE = No More Kinder Eggs ??

FDA's (Food and Drug Administration ) and the U.S. Customs and Border Protection (CBP) have a new regulation (effective Dec 12, 03), that restricts and regulates all food products shipped to USA. Due in part to the new Bio-Terrorism Act.
Once this new regulation is in effect (on December 12, 2003), all food products shipped to USA must be approved and registered with the FDA. Food products without FDA's approved and registration number on the package will either be returned to sender at sender's cost, or simply held in their custom storage centers awaiting for senders' claim. After certain days, unclaimed food products will simply be destroyed or discarded.
We, along with our major distributor, are going to appeal to the FDA for exemption. However, it would probably be a very time consuming and lengthy process. So please stay tune for any new update in our site...
If you order prior to December 8, 03 (3:00 pm Pacific time), your purchase will not be affected and will still be shipped as usual.   We will not accept any new purchase order after December 9, 03.
Does it means there will be no more Kinder Eggs in the US after Dec 12, 03 ? May be. Until new FDA regulations is changed or introduced.
If you still find some vendors selling Kinder Eggs to the US after December 10, be advised that it could mean that your order could never be delivered to you, even if you paid for it. As some vendors might not even aware of this new FDA regulation and keep sending Kinder Eggs to the US. What happen is, the Custom Agency will simply return the item to the sender, at sender's cost. Or they will hold the package in their custom agency warehouse awaiting for claim. After certain days, all unclaimed food products will simply be destroyed or discarded. So it will be a loss for both the seller and buyer. And the buyer could be left with paying for the products and never be able to receive the item. So it is suggested to hold off ordering any more Kinder Eggs after Dec 10, 03. Before ordering from other vendors, ask how they can guarantee your purchase will arrive, or if they can guarantee if the items are returned, can they refund you the full payment. Buyers beware.
Shall there be any change in this subject matter, we will post it on this site. So please check back often for any new update.
